Terms of service

These terms govern use of Surface, provided by Dolphin Analytics Ltd (UK). By creating an account or using Surface you agree to them.

The service

Surface is an analytics workspace for marketing agencies: it connects marketing platform accounts, computes reporting metrics from that data, answers questions about it, and generates reports. Features marked as rolling out are not part of the current service until released.

Your account and your clients

You are responsible for your account credentials and for everything done under your login. Where you connect accounts belonging to your clients, you confirm that you have the authority or consent to do so, and that connecting them does not breach your agreements with those clients. Client data you connect remains yours and your clients'; we claim no ownership of it.

Acceptable use

Do not attempt to access other tenants' data, probe or disrupt the service, resell access without agreement, or use Surface for anything unlawful. We may suspend accounts that do.

Fees

Pricing is per month, per tier, as shown on the pricing section of this site. Early adopter terms (first month free, first year half price for the first five agencies) apply as stated at sign-up. Prices may change with at least 30 days' notice; changes never apply retroactively to a paid period.

Data and portability

Your data lives in standard Postgres and can be exported on request at any time. Reports you export are yours to keep. On termination, we delete your data as described in the privacy policy.

Availability and support

Surface is provided as an early-stage product. We aim for high availability but do not guarantee uninterrupted service. Support is by email and we respond as fast as a small, founder-run team honestly can.

Liability

To the fullest extent permitted by law: Surface is provided "as is"; we are not liable for indirect or consequential losses; and our total liability in any 12-month period is capped at the fees you paid us in that period. Nothing in these terms limits liability that cannot lawfully be limited.

General

These terms are governed by the laws of England and Wales, with exclusive jurisdiction of the English courts. If a clause is found unenforceable the rest stand. We may update these terms with notice; continued use after the effective date is acceptance.
